Sobbing Martin Shkreli Sentenced to 7 Years in Prison for Securities Fraud and Being an Asshole

When “pharma bro” Martin Shkreli spoke with Gizmodo back in September, he told us he wouldn’t spend a single day in prison. Turns out, he was wrong.

Shkreli was sentenced to seven years in prison today by US District Judge Kiyo Matsumoto at a hearing in Brooklyn, with credit for time served since he was jailed in September. Shkreli was sobbing when he told the judge that he’s “not the same person [he] once was.” Prosecutors had asked for a 15-year sentence, while his lawyers had asked for 12-18 months.

The judge said that Shkreli’s own emails call into question his claims of remorse and mentioned the time that he wrote “Fuck the feds,” while also bragging that he wouldn’t serve any real time in prison. And it wasn’t a great sign for Shkreli when his own lawyer said in court that there were times he wanted to punch Shkreli directly in the face.

Shkreli’s lawyers argued that he shouldn’t be sentenced harshly, “simply for being Martin Shkreli.” Which is now an internationally recognized way of saying that someone is being an asshole.

“I’m old enough to be his father,” Shkreli’s lawyer, Benjamin Brafman, said before the judge issued the sentence. “There are times I want to hug and hold him... times I want to punch him in the face for some of the things he’s said.”

Earlier this week, Shkreli was ordered to hand over $7.36 million in assets, including the one-of-a-kind Wu-Tang record that he purchased for $2 million, Once Upon a Time in Shaolin. Shkreli was previously found guilty on two counts of securities fraud in August of 2017 after lying to his investors.

Shkreli first became a household name when he decided to jack up the price of a life-saving HIV drug called Daraprim from $13.50 to $750 a pill in September of 2015. Throughout the ensuing controversy and trial, the now 34-year-old seemed to relish the hate that was tossed his way in the press, but he (or his lawyer) wrote an uncharacteristically deferential letter to the judge last month.

The former CEO of Turing Pharmaceuticals has been in jail since September, when Judge Matsumoto revoked Shrkeli’s bail for offering a $5,000 bounty for some of Hillary Clinton’s hair on Facebook. He later called the post “satire” before taking down the post entirely. Neither kept him free.

“I have learned a very painful lesson,” Shkreli wrote in his February letter to the judge. “Never again will I prevaricate or omit or mislead—intentionally or not.”

“There are ways to communicate which eliminate the possibility of doubt and alternative interpretations of fact. I take responsibility for the fact that I used to behave and communicate in this way,” he continued. “It was wrong. I was a fool. I should have known better.”

But prosecutors weren’t buying it.

“Shkreli uses the letter to shift blame for his actions elsewhere—to his victims, to the government, to others he has encountered on social media, and to ‘demons who haunted me,’” the prosecutors argued in asking for a 15-year sentence. “Not once does Shkreli acknowledge that he lied to investors and committed fraud.”

Shkreli was never convicted of anything related to his disgusting business of price gouging, but instead was convicted of unrelated charges. He defrauded investors in two hedge funds that he operated and also lied about a company he founded in 2011 called Retrophin to keep its stock price artificially inflated.

While the judge emphasized that it was Shkreli’s crimes, not his outside conduct, that resulted in his sentence, it seems impossible that behavior like the Clinton hair bounty did not influence the severity of his punishment. 

Earlier this week, prosecutors told the court it should “consider Shkreli’s reprehensible conduct towards members of the public” when deciding his sentence, noting that his “inability to acknowledge that his actions constituted crimes, coupled with his other disdain for the criminal justice system (which has only escalated since his conviction), demonstrate that Shkreli is likely to commit similar crimes in the future.”

“Our sentencing submission could have been a lot worse,” prosecutors told the judge today when defending the call for as much as 15 years. “We didn’t go through years of tweets that we could have.”

So what will Shkreli do in prison? He told Gizmodo back in September that if he did go to prison he’d brush up on his reading and that he’d still be able to “make paper” from the inside. It’s unclear if Shkreli, who Judge Matsumoto said has a net worth of $27 million, still plans to “make paper” while serving his sentence. Maybe the prison has a DIY papyrus class.

President Donald Trump's former top political advisor Steve Bannon had some choice bit of advice for members of France's far-right National Front Party on Saturday as he told them they embrace those who criticize them as racists and xenophobes and where those charges as a "badge of honor" as opposed to something to deny or defend against.

"Let them call you racists," Bannon told the audience at the party's national conference in Lille. "Let them call you xenophobes. Let them call you nativists. Wear it as a badge of honor... because every day we get stronger and they get weaker."

Bannon also told the crowd they should recognize that they are part of something bigger than themselves—part of a global movement of similar-minded people. "And history," he said, "is on our side."

A contrast in ethics: SF ICE spokesperson quits rather than lie v. the whitewashing in the House GOP final report on Russian meddling in 2016 election

 

A spokesperson for U.S. Immigration & Customs Enforcement (ICE) just resigned rather than tell a bold-faced lie that Attorney General Jeff Sessions and other ICE officials have been floating. Sessions and other ICE-ers have been complaining that about 800 undocumented immigrants escaped arrest because Oakland Mayor Libby Schaaf warned the community that ICE raids were coming. ICE’s San Francisco spokesperson James Schwab knew the real number was much, much lower and recommended that ICE use the correct figure. ICE wouldn’t change its overblown estimate, so Schwab quit.

Good for him! Like the scientists and career diplomats who are abandoning the current administration, Schwab makes us remember that professional ethics and the truth take precedence over the pursuit of money and influence. His act shouldn’t seem heroic, but in our second Gilded Age, it does.

That Schwab’s act of integrity should be reported in the San Francisco Chronicle the same day that Republicans on the House Intelligence Committee abruptly ended their investigation into Russian interference in the last presidential election is the most bitter of ironies. Schwab placed the truth above politics. The Republicans have applied the thinnest of whitewashes to what all indications amounts to an enormous stain of collusion and cover-up. Over the frequent protestations of Democrats and some Republicans, the House investigation has been shoddy—not gathering enough evidence and not interviewing enough people. Moreover, the investigation took ridiculous detours, as when Republicans issued the Devin Nunes-produced memo that purported to show that Robert Mueller’s independent investigation was unwarranted but in fact only revealed that the FBI had plenty of cause to start their investigation (which morphed into the Mueller probe after the firing of FBI director James Comey).

The Republican’s latest conclusion—that Russia interfered in 2016 but not to favor any candidate—reminds me of the three monkeys who see, hear and speak no evil. Or perhaps the dignitaries politely applauding from their special loft as the Emperor sashays by in his birthday suit. Whereas Schwab wants us to look at the facts, House Republicans—and just about all of the current Republican power structure—want us to look away from a horrifying truth.

Republicans are too invested in the Donald Trump phenomenon to walk away from the Donald. Instead they try to protect him by issuing a report that they hope will short circuit the Mueller probe, which seems to be getting ever closer to proving that the Trump campaign colluded with Russia to sway the results of the 2016 presidential election in his favor. But by trying to cover-up the truth, the GOP subvert our democracy.

So what else is new?

The right wing, which has pretty much taken over the Republican Party, has done a lot to undermine our democracy over the past decade or so:

  • Established dozens of foundations, research centers and publications that routinely publish shoddy research and self-serving analysis of our economic challenges while pushing the right’s myth-based economic and social agenda.
  • Developed a huge alternative media universe that has spewed the right’s propaganda, pushed its agenda and sought to besmirch every prominent Democratic or progressive candidate.
  • Groomed a generation of Republican candidates and elected officials to be their willing and well-paid toadies.
  • Gerrymandered Congressional districts to give Republicans an edge.
  • Passed a number of laws that make it harder to register to vote and harder to vote.
  • Blocked the nomination of a centrist Supreme Court justice in hopes that a Republican president would nominate a more conservative judge.
  • Held their collective nose as the current administration—perhaps the most corrupt since the establishment of civil service rules in the late 19th century—breaks all rules of ethics in mixing government with private business, exploiting the White House for self-enrichment, using government funds for private inurement and rewarding contributors and cronies.

In the context of these subversions of democracy, perhaps the Republicans consider collusion to interfere with an election as fair play—even if does involve a global adversary trying to weaken us. As with Nixon’s treasonous backroom deal with the South Vietnamese government to postpone the Paris Peace talks until after the 1968 election and Reagan’s surreptitious deal with Iran to postpone release of the hostages in return for secret weapons sales, the Republicans have long tolerated treason in the service of winning elections.

The Republicans have both demographics and ideology against them. On economic and social issues, most Americans are centrists or progressive. Odds are they will look even more leftward politically in the future, as our population continues to become more ethnically diverse and younger voters with more progressive views replace older voters. The only way to maintain control for the benefit of the ultra-wealthy is to fix the system anyway they can.

You may have heard the name Matthew Heimbach in recent years. In 2016, he was arrested after he assaulted a black woman at a Trump rally in Kentucky. You can see that video below.

In 2017, he was one of the “very fine people” who organized the “Unite the Right” hate rally in Charlottesville, where counter protester Heather Heyer was killed by a Heimbach associate. 

Last week he was in Michigan to hear fellow white supremacist Richard Spencer speak at Michigan State University. (Students were on spring break and classes were not in session.) Naturally, Heimbach and his pals once again turned to violence, getting involved in a scuffle and throwing punches before their deplorable presence was turned away by a much larger crowd chanting, “Go home!” and “Nazis suck!” You can also see that video below.

But, this week Heimbach is in the news for his personal life. One that would be fitting for an episode of The Jerry Springer Show. It seems Heimbach has been cheating on this wife with her stepfather’s wife. (Who is apparently not Amber Heimbach’s mother. We can’t figure it out either.) From Vice News:

Matthew Heimbach, the chief of the Traditionalist Worker Party and one of the the most prominent leaders of the American white nationalist movement, was arrested on Tuesday for allegedly attacking both his wife, Brooke Heimbach, and her stepfather—fellow party leader Matt Parrott. According to a police report obtained by the Southern Poverty Law Center, the bizarre events leading to his arrest stemmed from a tryst gone awry.

Apparently, Heimbach and Parrott's wife, Jessica, had an affair that lasted three months. But Heimbach's wife reportedly wanted to see if her husband would continue the fling despite having said it was over, Talking Points Memo reports. On Tuesday, Matt Parrott and Brooke Heimbach reportedly stood on a cardboard box outside a trailer home and spied on their significant others from the window.

According to at least one account in the report, the two began to have sex and Parrott went inside to confront Heimbach. Parrot said he poked Heimbach in the chest, and then Heimbach allegedly "choked him out" and caused him to lose consciousness. When he came to, Parrott took his younger step-daughter to a Walmart and called the cops, telling them that Heimbach's wife may have taken a recording of the encounter. Meanwhile, Heimbach allegedly attacked his wife Brooke, grabbing her face and throwing her onto a bed. He was carted off to the Orange County Jail in handcuffs.

 
 

Heimbach has been charged with one misdemeanor count of battery and one felony count of domestic battery in the presence of a child under 16. This latest incident is probably going to catch the eye of the Kentucky judge who waived a jail sentence after he pled guilty to disorderly conduct in the case where he was seen violently shoving University of Louisville student Kashiya Nwanguma at that Kentucky Trump rally in 2016. He has a probation hearing in Kentucky on June 1. Matt Parrot, the White Nationalist spokesman and stepfather to Matthew Heimbach, says he’s done with the movement now.

“I’m done. I’m out,” Parrott told The Southern Poverty Law Center on Tuesday. “SPLC has won. Matt Parrott is out of the game. Y’all have a nice life.”

Richard Spencer Postpones College Tour No One Was Attending Anyway, Blames Antifa

White supremacist carnival barker and sometimes-literal punching bagRichard Spencer, whose ongoing college tour has seen plummeting attendanceas the number of potential audience members willing to be seen in his presence diminishes, might call it quits on the whole thing since it’s not “fun” anymore now that “antifa is winning.”

In an interview with USA Today on Monday, Spencer opined that clashes at his appearances—which despite weak showings from his side have continued to draw large crowds of anti-racist protesters that have sometimes grown violent—have made it so that he can’t continue enjoying antics like flailing around on stage or rambling at hecklers about “communist antifa.” As a result, future college speeches are indefinitely postponed.

“When they become violent clashes and pitched battles, they aren’t fun,” Spencer told the paper. “I don’t inspire any kind of violence... Until the situation changes, we are up a creek without a paddle.”

In a separate interview with the Washington Post, Spencer said that he can no longer hold college events publicized in advance because of how many protesters show up.

“Antifa is winning,” Spencer told the Post.

But Spencer added that he still intends to drop by said campuses publicly unannounced, which is really a great idea that totally does not ignore the fact his campus events are only possible because publicly funded colleges are often obligated by law to host him, and thus subsidize the lavish security measures often necessary to prevent him from getting punched again. Such a plan also relies on individuals with knowledge of when he’ll show up staying quiet, which is not really a good bet for a high-profile white supremacist.

Spencer might not have had much touring left to do anyways. Per the Forward, his only remaining appearance was at the University of Michigan, but the event still isn’t scheduled, and the lawyer he employed to sue his way past reluctant campus administrators recently announced he was quitting “after a series of articles about his racist past appeared in the Detroit Free Press.” According to Michigan Radio, University of Michigan President Mark Schlissel has remained adamant that they will only allow Spencer on campus if there is a guarantee of safety.

In any case, Spencer’s star within the movement—always tenuous and rooted mainly in his ability to get lots of indulgent press coverage—has fallen somewhat since an infamous white supremacist rally in Charlottesville, Virginia last year that resulted in three deaths and scores of injuries, per the Forward.

“For the public, his 15 minutes are over,” Political Research Associates associate fellow Spencer Sunshine told the Forward. For fellow racist activists, Sunshine added, “... There’s a reluctant acceptance of him. I think a lot of people don’t like him. He’s not such a uniter.”

SHANGHAI (Reuters) - China said it will begin applying its so-called social credit system to flights and trains and stop people who have committed misdeeds from taking such transport for up to a year.

People who would be put on the restricted lists included those found to have committed acts like spreading false information about terrorism and causing trouble on flights, as well as those who used expired tickets or smoked on trains, according to two statements issued on the National Development and Reform Commission’s website on Friday. 

Those found to have committed financial wrongdoings, such as employers who failed to pay social insurance or people who have failed to pay fines, would also face these restrictions, said the statements which were dated March 2. 

It added that the rules would come into effect on May 1. 

The move is in line with President’s Xi Jinping’s plan to construct a social credit system based on the principle of “once untrustworthy, always restricted”, said one of the notices which was signed by eight ministries, including the country’s aviation regulator and the Supreme People’s Court. 

China has flagged plans to roll out a system that will allow government bodies to share information on its citizens’ trustworthiness and issue penalties based on a so-called social credit score. 

However, there are signs that the use of social credit scoring on domestic transport could have started years ago. In early 2017, the country’s Supreme People’s Court said during a press conference that 6.15 million Chinese citizens had been banned from taking flights for social misdeeds.
